    This Privacy Notice relates to data about you and your interaction with our Services. 

    "Personal Data", for the purposes of this Privacy Notice, means any information relating to an identified or identifiable natural person (collectively, such person, "Data Subject").  An identifiable natural person is a person who can be determined,  directly or indirectly, in particular by reference to an identifier  such as name, identification number, location data, online identifier or to one or more determining factors of physical and physiological factors, the  genetic, mental, economic, cultural or social identity of that natural person.

    Check in

    We collect personal data when you use or interact with our website and services, including when you register with us.  To create an account with us, you will need to provide personal data including your name, email address and password.

    Interact with our site and make purchases

    We collect personal data when you use or interact with our website and services, including when you browse our products online or make purchases from us.  In order to book  a trip via BOTCOM, or to provide a  trip as a boat owner and receive payment, you will need to provide payment and billing information.

    Public Account

    You have options about the information you provide for your profile,  such as photo, spoken languages, and a short bio.  You do not have to provide additional  profile information about you, however, profile information helps you get more out of our services.

    Other than the personal information required to create an account (for example,  your name, email address, phone number, password), your choice is whether to include additional personal data in your profile.  We do not require you to provide sensitive personal data to complete your public profile. We recommend that you exercise caution in determining what information and content you wish to disclose in areas of our site that are accessible to the general public.  Please do not post or add personal data to your profile that you do not want to be publicly available.

    You and others may post content that includes information about you ( for example, as part of reviews of boats or charterers) on our Services.

    Use of the Service

    We record usage data when you visit or otherwise use our Services, including our sites and apps, such as  when you view or click on content (such as boat lists), perform a search, or install or update one of our mobile apps.   We use logins, cookies, device information, and Internet Protocol ("IP")  addresses to identify you and log your usage.

     

    Communications through our services and promotional materials

    We collect personal data when you contact us or register to receive promotional materials or information,  including your email address and phone number.  In addition,  we collect information about you when you send, receive, or handle messages related to our Services.  For example, if you receive a  booking inquiry or offer, we track whether you have acted on it and will send you a reminder to take further action.

    We also collect personal data from you when you submit, post or upload it to our site or via our Services,  such as when you submit a form (for example, a boat list) or upload a review photo to our site.

     

    Third Parties

    We may collect information, such as  name and email address, from publicly available sources and other third parties, such as marketing data providers, to help us provide and improve the Services and for marketing and advertising.  We may combine your personal data with data we obtain from our Services, other users or third parties to enhance your experience and improve the Services.

    How we use your data

    We use your personal data as set out in this Privacy Notice.  How we use your personal data may depend in part on how you use our Services and the choices you make in your settings.  We use the data we hold about you to provide, improve, and personalize our services,  including with the help of automated systems and the feedback we provide, so that they are more relevant and useful to you and others.

     

    Account management and service delivery

    We use personal data to administer your account,  including verifying your identity, authenticating and allowing access to our Services.  For example, we may collect user images as an additional security measure for identity verification and fraud prevention purposes.

     

    List of boats

    Our services help connect you with potential customers to complete bookings for boat charters or experience the waters you offer through our website.  To do so, you  can choose to publish a listing on our website with a description of what you offer, and interested customers will send a booking inquiry via our website.  When customers send you a booking inquiry, you'll be able to communicate with each other through personalized, automated messages (triggered by selecting a response) to discuss more details and perform common booking actions.  Customers can confirm the reservation and make payment through our website.

    We will use data about you and your listing to help others find your listing, and  sometimes to promote your listing and our services.   When a customer confirms a booking  with you, we will provide them with your contact information to facilitate communication outside our platform as desired or necessary.  We will also use your personal data in order to provide payment for booking a boat charter or a water experience commercial offer.

    Boat Rental

    Our services allow you to find and book boat rentals and water experiences.  We may use the data we have about you and the data you provide to show you listings that may match  your interests, and  we may send details about your booking query to list owners.

    When you submit a reservation enquiry, you and the  list owner will be able to communicate with each other through personalized and automated messages (triggered by selecting a response action) to discuss more details and implement common booking actions.  You can confirm your booking and make payment through our website.

    When you confirm a reservation, we will provide your contact information to the list owner to facilitate communication outside of our platform as desired or necessary.

    Communications & Marketing

    We may communicate with you via email, mobile phone, notifications  posted on our websites or apps, messages to  Botcom's inbox, and  other methods through our Services, including text messages and push notifications.  We'll send you messages about the availability of our services, security, or other service-related issues. We may also send messages about how the Services are used, and feedback regarding rental or booking inquiries and requests.  We may also use your personal information to send you promotional messages from us.

    We also enable communications between you and others through our Services,  including booking enquiries, offers and messages.

    We may also use personal data to send invitations and correspondence promoting our services.

    You can change your communication preferences at any time by visiting the Account Settings section of the Site.  Please be aware that you may not be able to opt out of receiving certain service messages or transactions from us,  including security and legal notices,  and communications related to the provision of services.

     

    Development of services and research

    Service Development

    We use anonymous data, including public comments,  for analytics purposes and to conduct research and development to further develop and improve our Services in order to provide you and others with a better, more intuitive  and personalized experience, and to increase membership growth and participation.  Our services, helping to connect owners and tenants to each other and to economic opportunities.

    Customer Support

    We use data (which can include your communications) to investigate, respond to, and resolve queries, complaints, and service issues.

     

    Aggregated insights

    We may generate anonymized or de-identified data from personal data by removing data components (such as your name, email address, or associable tracking identifier) that make the data personally identifiable to you, through obfuscation, or through other means, including for the purpose of producing and sharing aggregated insights that do not identify you.  For example, we may use your data to generate statistics about our members and boats on our Services.  Our use of anonymized data is not governed by this Privacy Policy.

     

    Crime prevention and legal purposes

    We use your data if we believe in good faith that it is necessary for security purposes or to investigate potential fraud or other violations of this User Agreement or Privacy Policy, and  /or attempts to harm our members or visitors, and for other lawful purposes, such as to comply with applicable laws and respond to lawful requests.

    Services

    Public user profile

    The information you provide to your public user profile is fully visible to anyone visiting the Site.

    Lists, wishlists, and reviews

    Our site allows users to view and share personal data,  including through lists, wishlists and reviews.

    • When you create a boat list,  all information you provide regarding the list will be publicly viewable,  including the title, description, and images of the list.
    • When you create a wish list,  unless you make  it private, it will be viewable by any member or visitor who has a link to the wishlist.
    • When you submit a review (e.g.,  text and images) publicly on our site, the public can view it.  Members, visitors, and others will be able to find and view publicly shared content,  including your name (and photo if you've submitted one).

     

    Service Providers

    We use third parties to help us provide our services (e.g.,  authentication, maintenance, analysis, audit, payments, fraud detection, marketing, and development) as permitted by law.  These third parties may have access to your information as reasonably necessary to perform these functions on our behalf, and are obligated not to disclose your personal data or use it for other purposes.

     Legal Disclosures

    It is likely that we may need to disclose information about you when required by law, subpoena, or other legal process, or when we have a good faith belief that disclosure is reasonably necessary (1) to investigate, prevent or take action on suspicion or illegal or unlawful activities or to assist government agencies; (2) enforce our agreements with you or third parties; (3) investigate and defend our rights and property, including against Any claims or allegations from a third party; (4)  protect the security or integrity of our Services; or (5) exercise or protect the rights and/or safety of Botcom,  our members, employees or other third parties.

    Change in control or sale

    We may also share your personal data as part of a sale, merger or change in controller or in preparation for any such events.  Any other entity purchasing us or part of us may continue to use your data only in the manner consistent with this Privacy Policy unless you agree otherwise.

     

    Your rights, choices and duties

    Data Retention

    We retain your personal data for as long as you maintain your account, as  needed to provide you with services, or as required by law.  This includes data that you or others have provided to us and data generated or inferred from your use of our Services, as described in this Privacy Policy.  For example,  if you use our Services when searching for a boat every few years, we will retain your personal data and keep your profile open in order to provide you with the Services until you decide to close your account (as described in the Account Closure section of this Privacy Policy), or we ask us to remove your personal data as described in this Privacy Policy.

     

    Rights to access and control your personal data

    We offer many options about collecting, using, and sharing your data , from deleting or correcting data you include on your profile and controlling your boat's visibility to opting out of ads and connection controls.

    In certain circumstances, you have the right to request confirmation from us as to whether or not we process your personal data.  For the personal data we have about you:

    • Data deletion: You can ask us to erase or delete all or some of your personal data (for example, if it is no longer necessary to provide services to you).
    • Data change or correction: You can modify some of your personal data through your account.  You can also ask us to change, update or correct your data in certain cases,  for example, if your information is inaccurate.
    • Object, restrict or restrict the use of data: You can ask us to stop using all or some  of your personal data (for example, if  we do not have a legal right to continue using it) or to restrict our use of it (for example, if your personal data is inaccurate or unlawfully held).
    • Right to access and/or collect your data: You can ask us for a copy of your personal data and you can request a copy of the personal data you have provided in a machine-readable form , or send this data to another controller.

    You can also exercise your rights by contacting us at the contact information below.  As permitted by law,  certain data elements may not be subject to access, modification, portability, restriction and/or deletion.  Furthermore,  where permitted, we may charge for this service.  We will respond to reasonable requests as soon as reasonably practicable and as required by law. 

     

    Account Closure

    If you wish to close your Botcom account  , please contact  our support team  .  Your personal data will generally cease to appear publicly to others on our site within 72 hours of receiving a request to close your account. We generally delete locked account information from our systems within 30 days of receiving your account closure request, except as stated in this Privacy Policy.

    We may retain your personal data after closing your account if it is reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our user agreement, fulfill your request to "unsubscribe" from other messages from us, or for other legal purposes.  We may retain anonymous information after your account is closed.

    Please note that information you have shared with others (for example,  by posting a review on our site) may remain visible after you close your account or delete information from your profile or mailbox, so we recommend that you exercise caution in determining what information and content you wish to disclose in areas of our site that are accessible to the general public.  The audit content associated with closed accounts will show an unknown user as the audit source. Your profile may continue to display in other people's services (for example, search engine results) until these third parties update their cache.

    Security and links to third-party sites

    We implement technical and organizational security safeguards designed to protect your personal data, such as HTTPS.  We regularly monitor our systems for potential vulnerabilities. However, please be aware that we cannot completely eliminate the security risks associated with the storage and transfer of personal data.

    This Privacy Notice applies to Botcom only.  Our Site or Services may provide a link or otherwise provide access to another website, mobile application or other Internet site (collectively, "Third Party Sites"). We provide these links only for your convenience.  We have no control  over third party sites,  do not review them, and are not responsible for third party sites, their content, or any goods or services available through third party sites.  Our Privacy Policy does not apply to third party sites,  and any data you provide to third party sites, you provide at your own risk.  We encourage you to review the privacy policies of any third-party sites you choose to interact with.
